bant.io is owned and operated by Bant.io Limited, United Kingdom. By registering, accessing or using any services developed, operated, maintained or hosted by bant.io, including all websites and IP addresses available at and configured for use at https://www.bant.io, you agree to be bound to the following terms and conditions (“Terms of Service.”) and you agree that it is enforceable as if it were a written negotiated agreement signed by bant.io and you.
bant.io, at its sole discretion, reserves the right to revise, update and change the Terms of Service from time to time without notice to you, and you agree to be bound by such modifications or revisions. Any new features that augment or enhance the current Service, including the release of new features and resources, shall be subject to the Terms of Service. You agree to use bant.io at your own risk.
BY CONTINUING TO USE THE SERVICE, YOU ARE CONFIRMING YOUR CONSENT AND AGREEMENT TO BE BOUND BY THE MOST RECENT TERMS OF SERVICE.
- You must be 18 years or older to use bant.io.
- You are required to provide a valid email address, and any other information requested in order to complete the signup process and/or continue to use bant.io. bant.io reserves the right to terminate your use of the services upon the discovery that the information you provided is not complete or accurate.
- You are responsible for all content (including email content) that is part of your campaign operation.
- You may not use bant.io for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright, spam, or trademark laws).
- You are responsible for complying with all applicable local, state, national and foreign laws relating to your use of the service. You may not violate any applicable law or regulation; post or transmit any materials that violate any applicable local law; use the service for any fraudulent or inappropriate purpose.
- You may not use any robot, spider, other automated device, or manual process to monitor or copy any content from bant.io.
- You may not resell, duplicate or reproduce or exploit any part of the service without the express written consent of bant.io.
- bant.io may modify, suspend or discontinue this service at any time, for any reason, at its sole discretion. bant.io reserves the right to refuse service to anyone for any reason at any time.
- bant.io claims no ownership, responsibility or intellectual property rights over any of the content or materials you provide to bant.io.
- If you cancel or terminate your Service, all of your content, data, information, text, files, documents, images may be immediately deleted from the Service.
- In circumstances whereby a customer requests the transfer of a domain ownership, a transfer fee of $95 is required to be paid by the customer prior to the transfer.
- All packages are billed monthly or quarterly in advance. Once the initial period paid for has come to an end (i.e., either the month or quarter selected by the client), the package will automatically renew on the same basis (the same time period and package), unless the client expressly requests a change is made to this arrangement within at least 48 hours of the billing date.
- No refunds or credits for partial months of service are granted, nor upgrade/downgrade refunds, or refunds for months unused with an active account.
- Refunds for the first month of a new campaign on a monthly, not quarterly, billing cycle can only be granted a) if the minimum lead number specified in the monthly plan are not met b) if the content of the emails has not been significantly changed at the customers express request, as such changes, which deviate from the email copy created and provided by bant.io, can impact considerably on the overall results of the campaign and c) if the targeting criteria has not been significantly changed compared to the criteria that was initially provided by the client.
- The ‘new client’ guarantee applies exclusively to the first month of a new campaign. In the event of clients failing to receive the minimum number of leads guaranteed in first month of a new campaign purchased on a monthly billing cycle (guarantees are not offered for quarterly billing as such plans are designed for existing, not new, clients in the second or subsequent months of an ongoing campaign), bant.io will continue the campaign at their expense, including additional leads and/or newly written email copy, for an additional 60 days (90 days in total) following the deployment of the campaign (i.e., after it has been set up and the client has approved it) to make up the shortfall i.e., to ensure delivery of the minimum amount of leads specified in the plan for the first month only i.e.;
Should bant.io fail to make up the shortfall in leads (the difference between the minimum lead quota specified in the plan for first month only) within the specified 90-day timeframe detailed above, the client can request an immediate refund. Eligible refunds must be submitted by email (firstname.lastname@example.org) within a maximum of 14 days once the refund eligibility period starts.N.B., a minimum quota of leads is guaranteed for first month of a new campaign as per the package selected by the client. If there is a shortfall in that first month, then only the number of leads which were not delivered are delivered in the subsequent months if the campaign ceases; if the campaign continues for a second month then the shortfall from month one (the number of leads not delivered) is added in the next month to make up the shortfall in a previous month in addition to the leads delivered in month two.The guarantee is subsequently based on ensuring that the leads – companies bant.io reach out to that respond with interest – match the criteria set in the client profiles during onboarding process.
- 5-8 Hot Leads for the ‘Start-up’ plan
- 10-15 Hot Leads for the ‘Medium’ plan
- 20-30 Hot Leads for the ‘Established’ plan
- bant.io reserves the right to terminate or suspend an account for non-payment of the subscription dues.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
- bant.io reserves the right to change service fees with 30 days notice. Such notice may be provided at any time by posting the changes to the bant.io website (https://www.bant.io) or through email. Existing customers will be grandfathered in.
Cancellation and Termination
- You are solely responsible for cancelling your account in the correct manner. You may cancel your account at any time by contacting us. We require a minimum of 48 hours cancellation notice prior to your next billing date.
- There is no cancellation fee.
- All of your Content may be immediately deleted from the Service upon cancellation. Once your account is cancelled, your Content cannot be recovered.
Intellectual Property Rights
- You agree that bant.io owns all rights to the code, databases, visual-design and layout of the service itself.
- bant.io claims no intellectual property rights over the material you provide to the service.
- You may not duplicate, copy, or reuse any portion of the content of bant.io’s service without the express written consent of bant.io.
Warranties and Liability
bant.io does not warrant that:
- the service will meet your requirements or expectations.
- the service will be uninterrupted, timely, secure, bug or error-free.
- the calculations performed by the service are accurate.
- any errors or bugs in the service will be corrected.
You expressly understand and agree that bant.io shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if bant.io has been advised of the possibility of such damages), resulting from your usage of the service.
- Your use of the service is at your sole risk. You acknowledge, understand and agree that bant.io provides the service to you “As Is” and “As Available” without warranty or condition of any kind.
- Technical support is only provided to paying account holders and is available as per the terms of your account.
- You understand that bant.io uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run and manage the service.
- You acknowledge, understand and agree that bant.io cannot guarantee the security of your data while it is being transmitted over the Internet and through servers that are out of our control.
- You must not modify, adapt or hack the service or modify another website so as to falsely imply that it is associated, linked to, or partnered with bant.io.
- Verbal, physical, written or other abuse of any bant.io customer, employee, member, or officer will result in immediate account termination and legal action.
- You agree to defend, indemnify, and hold harmless bant.io, its officers, directors, employees and its agents from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or resulting from your use of the service or your violation of this Terms of Service.
- You agree to receive administrative and legal notices about the service electronically via email or snail mail.
The failure of bant.io to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and bant.io and govern your use of the service, superseding any prior agreements between you and bant.io (including, but not limited to, any prior versions of the Terms of Service).
